This Offer from Individual Entrepreneur DENIS BURKOV, hereinafter referred to as the "Operator", who operates the website https://aegisvpn.me/, addressed to the user of the website, hereinafter referred to as the "User", is an offer to enter into a licensing agreement regarding the right to use the AegisVPN software product and defines the main terms of use of the specified software product via the website available at https://aegisvpn.me/. The User, acting to obtain the right to use the AegisVPN software product, accepts the terms of this Public Offer on the following conditions.

1. DEFINITIONS

1.1. Public offer (hereinafter - Offer) - a public proposal by the Operator, addressed to an indefinite number of persons, to enter into a licensing agreement with the Operator remotely (hereinafter - "Agreement") under the terms contained in this Offer, including all Appendices.

1.2. License - the scope of methods and terms of use of the AegisVPN software product, provided to the User based on their choice of one of the tariffs and its payment. Payment for the License constitutes full and unconditional acceptance by the User of this Offer.

1.3. Tariffs - pricing system for the License.

1.4. User - an individual who has expressed their agreement with the terms of this Offer and is interested in obtaining the right to use the AegisVPN software product under the terms outlined in the Offer.

1.5. Merchant of Record - Paddle.com, the Operator's authorized online reseller, through which payments for the License are processed and which is responsible for order processing, customer service inquiries, and refunds, as described in clause 7.4.

2. GENERAL PROVISIONS

2.1. The Operator grants the User a non-exclusive right to use the software product under the terms of a specific License described in the Tariffs, for a fee paid by the user through payment methods available on the website https://aegisvpn.me/. Payment for the License confirms the User's agreement to conclude this Agreement (acceptance of the offer).

2.2. By entering into the Agreement, the User confirms the following:

a) The User is fully aware of and agrees with the terms of the Offer;

b) The User gives consent to the collection, processing, and transfer of personal data under the conditions specified in the Privacy Policy posted on the website https://aegisvpn.me/.

2.3. The provisions of the Offer apply in the relationship between the Operator and the User, starting from the moment the User begins using the website and pays for the License. The Operator may at any time unilaterally modify this Public Offer without prior agreement with the User. New terms for previously concluded agreements with the User take effect from the moment the User pays for the new License, including in the case of payment for a new License via the recurring payment system.

2.4. The Operator may also unilaterally change the scope of rights and methods of using the AegisVPN software product provided under a specific License and Tariff. For the User who has paid for the respective License, such rules will take effect only from the moment the User pays for the new License, including in the case of payment for a new License via the recurring payment system.

3. LICENSE FEE

3.1. The amount of the licensing fee for the right to use the AegisVPN software product is specified on the website https://aegisvpn.me/ in the Pricing section.

3.2. The Operator has the right to unilaterally change the licensing fee amount specified in the Pricing for any Tariff.

3.3. The Operator may not change the licensing fee amount for an already paid License. Upon expiration of the current License, the User must pay the licensing fee in effect at the time of such payment to continue using the License for the new term.

3.4. The User's payment obligations for the License are considered fulfilled from the moment the full payment is received in accordance with the Pricing.

3.5. Payments for the licensing fee for the right to use the AegisVPN software product are processed through the Operator's authorized online reseller and Merchant of Record, Paddle.com, using the payment methods available on the website https://aegisvpn.me/. As Merchant of Record, Paddle.com acts as the seller of record for the transaction: the User purchases the License through Paddle, while the right to use the AegisVPN software product is licensed to the User by the Operator. The terms of payment, invoicing, and refunds are additionally governed by Paddle's terms and conditions.

3.6. By paying for the License, the User also confirms their acquaintance with the Agreement on joining the recurring payment system and agrees to pay the licensing fee for the right to use the AegisVPN software product through automatic deductions from the User's bank card, processed by Paddle.com as the Merchant of Record.

4. LICENSE ISSUANCE

4.1. The selection of a suitable License for the User is made through the website https://aegisvpn.me/ or by sending an invoice to the client's email.

4.2. When selecting a suitable License for the User on the website https://aegisvpn.me/, the User agrees to provide an email address.

4.3. If the Operator requires additional information, they have the right to request it from the User. If the User fails to provide the required information, the Operator is not responsible for any delay in issuing the License or for the User's inability to use the License.

4.4. The User is responsible for the accuracy of the information provided when submitting the License.

4.5. The agreement between the Operator and the User is considered concluded from the moment the User pays the licensing fee for the chosen License.

4.6. If the User did not use the "Cancel Subscription" form on the website https://aegisvpn.me/, the term of the License granted to the User will be extended for the same period upon expiration of the initial License term, according to the terms specified in the Pricing section on the website https://aegisvpn.me/ on the date of such extension (auto-renewal of the License). For Licenses purchased through Paddle.com, cancellation of auto-renewal and any related refunds are handled in accordance with Paddle's terms and conditions, including any notice period required by Paddle prior to the renewal date.

5. LICENSE

5.1. The License includes a certain scope of rights and methods for the User to use the AegisVPN software product, which the User is entitled to use during a specified period.

5.2. The License is considered granted to the User for the term specified in the License from the moment the User pays the licensing fee for the License, which is confirmed by the data from the User's personal Account on the website.

5.3. From the time specified in clause 5.2, the User is entitled to use the AegisVPN software product through their personal Account.

6. TERMINATION OF LICENSE

6.1. The User may refuse the License at any time during the term of the Agreement. Refunds of the licensing fee are handled by Paddle.com (the Merchant of Record) in accordance with the Refund Policy published on the website https://aegisvpn.me/refund-policy/ and with the applicable consumer protection legislation. Where no refund applies, the termination date of the Agreement is considered to be the expiration date of the paid License.

6.2. If the User does not contact the Operator in writing at the addresses specified on the website https://aegisvpn.me/ with a proposal to terminate the Agreement, the Agreement is considered valid until its termination by mutual consent of the Parties.

6.3. The Operator has the right to limit the User's right to use the AegisVPN software product in the ways specified in the License if there are facts of fraudulent use of the AegisVPN software, namely:

a) The use of the AegisVPN software by the User for the purpose of violating the legislation of the Russian Federation or the legislation of other countries;

b) The transfer of individual access keys, including authentication data for accessing the personal Account on the website, to third parties (except for the User's close relatives);

c) Exceeding the quota of 500 gigabytes of traffic used within the AegisVPN software product over 30 days. If this threshold is exceeded, the right to use the AegisVPN software product will be automatically suspended. In this case, the User may contact the Operator using any available communication channels and request an increase in the traffic limit. The Operator is obliged, in response to such a request from the User, to increase the traffic limit to 1 terabyte for the User for the term of the current paid License no more than once every 30 days.

7. LIABILITY OF THE PARTIES

7.1. The User agrees not to use the AegisVPN software product for sending spam, port scanning, proxy usage, conducting mass mailings (even if the emails are actually sent through another server), or carrying out hacking attacks on other computers or networks.

7.2. Coverage area, internet speed, and connection quality when using the AegisVPN software product may vary. The Operator agrees to do everything possible to ensure that the use of the AegisVPN software product is available at all times (except for maintenance and repair breaks). The use of the AegisVPN software product under the paid License may be unavailable due to factors beyond the Operator's control, including emergencies, network issues or restrictions, interference, signal interruption, or disruptions in other services.

7.3. The Operator is not responsible for the loss of data and messages, incorrect page rendering due to network issues (e.g., on a T-1 line). To protect Users, the Operator may unilaterally impose restrictions on the use of certain data and block customer service. Network speed is a nominal estimated characteristic, and it does not reflect the actual speed of sending and receiving data. The actual network speed depends on its configuration, data compression methods, network load, and other factors. The Operator does not guarantee the timeliness of data reception and is not responsible for any delays or losses.

7.4. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
